This User Agreement ("Agreement") is a legally binding contract between you ("User" or "You") and AutoVolt Gear ("we," "us," or "our"), governing your use of our website (the "Site") and purchase of products from us. By accessing the Site, placing an order, or accepting delivery of products, you acknowledge that you have read, understood, and agreed to be bound by all terms and conditions herein. If you do not agree, please refrain from using the Site or purchasing our products.

1. Eligibility

To place an order on the Site, you must be at least 18 years of age and possess the legal capacity to enter into a binding contract. You represent and warrant that all information you provide during the ordering process is accurate, complete, and current. We reserve the right to refuse service to any User at our discretion.

2. Order Placement and Confirmation

2.1 When you submit an order through the Site, you are making a binding offer to purchase the selected products at the listed prices. We reserve the right to accept or reject your order for any reason, including but not limited to product unavailability, pricing errors, or suspected fraudulent activity.

2.2 Upon receiving your order, we will send a confirmation email to the address you provided, acknowledging receipt of your order. This email does not constitute acceptance of your order; final acceptance occurs only when we dispatch the products and send a shipping confirmation email.

2.3 We may modify or cancel an order at any time before delivery if circumstances beyond our control (e.g., supplier issues, natural disasters) prevent us from fulfilling it. In such cases, we will notify you promptly via email.

3. Payment Terms (Cash on Delivery Only)

3.1 Our Site exclusively supports Cash on Delivery (COD) as the payment method. No advance payment, deposit, or online payment is required. You must pay the full order amount in cash to the courier at the time of delivery.

3.2 The order amount includes the product price, standard shipping fee (if applicable), and no additional COD-related charges. All prices listed on the Site are in U.S. Dollars (USD) and are subject to change without prior notice, though confirmed orders will be honored at the price listed at the time of order placement.

3.3 If you fail to provide the full cash payment upon delivery, the courier will refuse to hand over the products, and the order will be deemed canceled. We may charge a reprocessing fee if you request redelivery of a canceled COD order.

4. Delivery and Risk of Loss

4.1 We will arrange for delivery of products to the address you provided during order placement. Standard delivery times range from 2 to 7 business days, depending on your location. We will provide a tracking number via email once the order is dispatched.

4.2 You must be present at the delivery address to accept the order and make payment. If no one is available to receive the delivery, the courier will attempt delivery up to two additional times. If delivery fails after three attempts, the order will be canceled, and no refund will be issued unless the failure is due to our error.

4.3 Risk of loss or damage to the products passes to you upon delivery. You should inspect the products at the time of delivery; if they are damaged, defective, or incorrect, you may refuse acceptance and notify us within 24 hours of the attempted delivery.

5. Product Returns and Refunds

5.1 You may return unused, undamaged products in their original packaging within 30 days of delivery for a full refund. Custom or personalized products are not eligible for return unless defective.

5.2 To initiate a return, contact our customer support team with your order number and details of the product. We will provide instructions for returning the product, and we will cover the return shipping cost if the return is due to a defective or incorrect product. For change-of-mind returns, you are responsible for return shipping fees.

5.3 Refunds for eligible returns will be processed within 3 to 5 business days after we receive and inspect the returned product. Since payments are made via COD, refunds will be issued via bank transfer or digital wallet; you must provide your valid account details to receive the refund.

6. Product Warranty

6.1 All our products come with a standard 2-year warranty from the date of delivery, covering defects in materials or workmanship. The warranty does not cover damage caused by improper use, installation, accidents, or normal wear and tear.

6.2 To claim warranty service, contact our support team with your order number and evidence of the defect (e.g., photos, description). We may repair, replace, or refund the product at our discretion, free of charge.

7. Privacy and Data Protection

7.1 We collect and use your personal information (e.g., name, address, contact details) solely to process your order, arrange delivery, and provide customer support. We do not store your payment information (as payments are made in cash) and will never share your personal data with third parties for marketing purposes without your explicit consent.

7.2 We use industry-standard security measures to protect your personal information from unauthorized access, use, or disclosure. You have the right to request access to, correction of, or deletion of your personal data by contacting our support team.

8. Limitation of Liability

8.1 To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages (including but not limited to loss of profits, business interruption, or loss of data) arising from your use of the Site or purchase of our products, even if we have been advised of the possibility of such damages.

8.2 Our total liability for any claim related to this Agreement shall not exceed the total amount you paid for the relevant product(s) giving rise to the claim.

9. Modifications to This Agreement

We reserve the right to modify or update this Agreement at any time. Any changes will be posted on the Site with a revised "Last Updated" date. Your continued use of the Site or purchase of products after the changes take effect constitutes your acceptance of the modified Agreement.

10. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles.

Any disputes arising out of or relating to this Agreement shall first be resolved through good-faith negotiation between you and us. If negotiation fails, the dispute shall be submitted to binding arbitration in Los Angeles, California, in accordance with the rules of the American Arbitration Association. The decision of the arbitrator shall be final and binding on both parties.
